Battery & Retaliation in California--My manager slapped me, then retaliated after I confronted her?
My manager ("X") put her left hand on my back to hold me down, then swung a HARD blow to my left ock with her right hand. It reminded me of a dominatrix/o style offense. I sent X an email that I would not tolerate her behavior, then repeated that statement verbally. I bcc'd the email to the owner of the company, and requested that he not say anything, as I didn't want the situation to escalate (quite frankly, I was scared of X's retaliation if she knew I told the owner). Within 2 hours of my verbally confronting X, she began resolution of a complaint against my husband, who also works for the same company. She fabricated facts and then docked my husband $250.00 pay based on the lies (I have company printouts that prove the lies), and that prove he is being singled out for disparate punishment. I'm feeling unsure of what to do--I am getting advice to sue X for battery and to hold the company vicariously liable--but this wasn't in the scope of her employment, was it?
